Terms and Conditions

GENERAL PROVISIONS

  1. These Regulations define the terms and conditions for the provision of Services in accordance with the Act of July 18, 2002 on the provision of services by electronic means, through the Website.
  2. As a condition for using the Services provided by CyberJob.pl, the User must accept the Privacy Policy and the following Regulations.
  3. The Regulations are effective as of March 1, 2023.
  4. All terms used in the Terms of Service and regulated in the Regulations have the meaning given therein.
  5. Evention's contact person for all matters related to CyberJob is Kamila Westfalewicz, e-mail: kamila.westfalewicz@evention.pl.
  6. Any User who does not accept the Terms and Conditions should immediately cease using the Service.

DEFINITIONS

  1. Website / Internet Portal - is a website located on the domain www.cyberjob.pl, the rights to which belong to the Service Provider.
  2. CyberJob.pl or Service Provider - the website of CyberJob, the entity that owns the service - Evention sp. z o.o., 1 Rondo ONZ St., 00-124 Warsaw, +48 tel. (22) 535-30-33, kontakt@evention.pl, REGON: 146871262, NIP: 5252564839, registered under KRS no.: 0000483800 in the Register of Entrepreneurs by the District Court for the City of Warsaw, XIII Economic Department of the National Court Register, share capital: PLN 5,000 (paid in full).
  3. User - is an adult natural person, using the Services provided through the Site. A person using the Site who can view content posted on the Site.
  4. Survey - completing and submitting one of the surveys located at the following web addresses: https://www.surveymonkey.com/r/Cyberjob or https://www.surveymonkey.com/r/thebestworkplaces.
  5. Submission - completion of a Survey and acceptance of the Terms and Conditions.
  6. Announcement, Business Card, Content - an announcement, information about a company published by an Advertiser on the Website, through an Application under the Agreement with CyberJob.co.uk or published by CyberJob.co.uk on the order of an Advertiser..
  7. Advertiser - a legal person or an organizational unit without legal personality, which is granted legal capacity by the Law, but also a natural person running a business, who is a customer of CyberJob. pl and placed an Advertisement, Business Card on the Website by means of an Application through a Survey, or a natural or legal person, or an organizational unit without legal personality, which is granted legal capacity by the law, having the status of an entrepreneur as defined by the applicable regulations, who is a customer of CyberJob.pl and placed an Advertisement, Business Card on the Website by means of an Application through a Survey.
  8. Parties - in the combined meaning - the User and the Service Provider.
  9. Agreement - an agreement for the provision of Services concluded between CyberJob.pl and the User and/or the Advertiser.
  10. Services - services provided electronically within the meaning of the Act of July 18, 2002 on providing services electronically by Cyberjob.pl to the Advertiser and the User.
  11. Rules and Regulations - these Rules and Regulations, being the Rules and Regulations within the meaning of Article 8 of the Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended), together with the Privacy Policy.
  12. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC; 2.14.
  13. Cookies Policy - the policy regulating the principles and scope of use of cookies and other similar technologies by the Organizer available at https://evention.pl/polityka-cookies-stron-internetowych-evention/.and https://cyberjob.pl/polityka-prywatnosci/.
  14. Privacy Policy of the CyberJob website - determines the manner of data processing, including the transmission of Notifications.   15. Content - any content published by Announcers on the Service, by completing a survey. In particular, written content, information, graphic and multimedia elements.

USE OF THE WEBSITE

  1. Access to browse the Service, including the Announcements and Content of the Announcers is free and available to all Users.
  2. Users access the Service by searching for Advertisements/Posters and Content of interest to them, which may lead them to associate with a potential Employer through the contact information contained in the Advertisement, Posting or Employer contact tool.
  3. The Service does not constitute an employment agency, but provides a platform that can connect the Announcer, the Employer and the Users of the Service.
  4. An advertiser posting an Announcement, business card of his/her organization on the Service submits his/her materials and data by completing and submitting a Questionnaire.y.
  5. CyberJob.pl is not responsible for the accuracy of the information submitted by the Announcers. Evention processes the information as an intermediary, only to the extent that the information can be posted on the platform.
  6. CyberJob.pl is not responsible for the Content and Announcements posted by Advertisers. It also does not verify them on an ongoing basis in terms of their compliance with the Regulations and the provisions of applicable law. Actions to verify the legal nature of the Content are undertaken by Cyberjob.pl only upon receipt of a report of violation.
  7. The advertiser is solely responsible for the posting of Content on the Service. The Advertiser warrants that the Content will not infringe the rights of third parties and indemnifies CyberJob.pl from any liability in this regard.
  8. The Advertiser, by posting or submitting Content to CyberJob.pl, grants CyberJob.pl a non-exclusive license to use, fix in computer memory, modify, delete, complete, perform publicly, display publicly, reproduce and distribute (especially on the Internet) such Content, including through various marketing communication channels.
  9. Correct use of the CyberJob.co.uk Website by the User is possible by meeting technical requirements.

TECHNICAL SPECIFICATIONS

Technical requirements necessary to use the Services of the Website:

  1. To use the Service, it is necessary to have a device (computer, smartphone or other multimedia device) with Internet access (recommended connection of at least 512 kbps), and a web browser.
  2. It is recommended to enable cookies and JavaScript in your web browser;
  3. In order to use some of the Service's functions, it may be necessary to have additional software (e.g. Flash, word processor, programs supporting PDF format, etc.).
  4. The Service Provider informs that the use of the Services provided through the Website may involve the following risks:
      1. malware attacks (malware, viruses, worms, etc.);
      2. blocking access to the Services (email bomb, DdoS);
      3. spam (unwanted or unnecessary electronic messages).

CyberJob.co.uk will make every effort to ensure that the Service operates correctly and within the scope of all features offered at all times, but reserves the right to temporarily disable the Service or its individual features in order to improve them, add new features or perform repairs or maintenance.

7. Costs arising from the use by the User of means of remote communication (costs of Internet connection, SMS, telephone calls) in order to use the Services of the Website, shall be borne by the User in accordance with the price lists of the providers whose services he uses.

CHANGES THE TERMS & REGULATIONS

  1. Evention, CyberJob.pl reserves the right to make changes to the Terms of Service, both with respect to Advertisers and Users who are consumers only if the change is required by applicable law, and in order to improve the quality or expand the scope of the Services provided.
  2. Beginning of the User's use of the Website implies acceptance of the Regulations as amended. The current version of the Regulations can be found at https://cyberjob.pl/regulaminhttps://cyberjob.pl/regulamin

USE OF THE SITE BY ADVERTISERS

  1. Employers, potential advertisers can post an Ad, Business Card by completing and submitting, one of the questionnaires located at the following web addresses: https://www.surveymonkey.com/r/Cyberjob or https://www.surveymonkey.com/r/thebestworkplaces
  2. Employers, potential advertisers may also place an Ad, Business Card by sending a request with information about the organization, directly to: kamila.westfalewicz@evention.pl or through the contact form located at https://cyberjob.pl/o-nas/.
  3. Any kind of remarks or corrections in the Announcements, Advertisers can submit an email to kamila.westfalewicz@evention.pl
  4. Employers, Advertisers shall comply with the prohibition of providing Content by or to the Service:
      1. causing a disturbance or overload of the Service or other entities directly or indirectly involved in the provision of electronic services,
      2. that may violate the personal rights of third parties, intellectual property rights including copyrights, business secrets, or otherwise violate the applicable legal order or good morals, in particular those containing violence, pornography, promotion of drugs and other illegal substances, inciting to commit crimes, or promoting gambling,
      3. containing computer viruses, "Worms", "Trojans", "keyllogers", or other source codes, files, folders, computer programs harmful to the Site,
      4. causing distribution of unsolicited commercial information (SPAM),
      5. others of an unlawful nature.
      6. CyberJob.pl removes from the Service Content that violates the law and the Terms of Service in accordance with the applicable regulations.

RIGHTS AND OBLIGATIONS OF ADVERTISERS

  1. The Advertiser agrees that CyberJob.co.uk may publish marketing information on the Service regarding other Services provided by CyberJob.co.uk (Evention) or its partners. Evention shall be entitled to remove obsolete and to modify the posted Content in order to improve the quality of the Service
  2. The Service offers the following Services to Advertisers:
      1. providing space on the Service to publish Content, including Job Postings,
      2. providing the possibility to edit published Advertisements, by sending e-mail comments.
      3. providing tools to post Advertisements, Business Cards,
      4. the possibility of promotion in social media, including in particular Facebook, Twitter and LinkedIn

PROCEDURE FOR REPORTING VIOLATIONS

  1. In the event that any Content posted by Employers on CyberJob.pl infringes the law, in particular intellectual property rights or personal rights of third parties, or is in violation of the Terms and Conditions, any User may report this fact to Evention by sending an email to kamila.westfalewicz@evention.pl.
  2. Upon receipt of such message, CyberJob.pl shall assess its credibility and take action in the form of removing or blocking access to the Content indicated in paragraph 1, in accordance with the applicable regulations in this regard.
  3. In the case specified in item 2, CyberJob.pl shall not be liable to persons whose rights have been violated, as well as to Users, for providing the Website Services in violation of the Regulations.

FINAL PROVISIONS

  1. The Regulations are effective as of March 1, 2023.
  2. The Regulations may be amended. Each Announcer will be notified of changes to the Regulations via an email sent to the email address indicated when completing the Survey. The message will contain a link to the amended Regulations.
  3. Amendments to the Terms and Conditions shall become effective no less than 7 days after the amended Terms and Conditions are made available on the Site.
  4. Acceptance of changes to the Terms and Conditions takes place by continuing to use the Service after the changes to the Terms and Conditions become effective - this applies to both Announcers and Users. Provided that the new amendments to the Regulations shall apply to Contracts concluded before the amendments to the Regulations.
  5. The User may, at any time, access the current version of these Regulations through a bookmark placed on the Site in a manner that allows obtaining, reproducing and recording the contents of the Regulations by means of a data communications system used by the User, including making printouts.
  6. Matters not covered by these Regulations shall be governed by generally applicable provisions of Polish law, in particular the Civil Code and the Act on Electronic Provision of Services.
